Zookzy Terms of Service

Operator: Zookzy AI Technologies (Pvt) Ltd, trading as Zookzy ("Zookzy", "we", "us").
Statutory information and contacts are on the Contacts page.
These Terms of Service ("Terms") govern access to our websites, applications, APIs, bots, and related services (together, the "Service").
This text is not legal advice and does not create an obligation to provide advice for your specific situation.

1. Acceptance and changes

By creating an account, posting content, or otherwise using the Service, you fully and unconditionally agree to these Terms, the Privacy Policy, and the Cookie Policy. If you do not agree, you must stop using the Service immediately.

We may change the Terms at any time. The current version is always published on the website. We may (but are not obliged to) notify you of material changes by email or through the interface. Continued use of the Service after the effective date of changes constitutes your unconditional acceptance of the new version, except where applicable law requires explicit consent.

2. Legal capacity and authority

You must be at least 18 years old (or the age of majority in your jurisdiction if it is higher than 18). You must have the legal capacity to enter binding agreements. If you use the Service on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms. If you lack legal capacity, you may not use the Service and any registration you make is void.

3. Nature of the Service (contact platform only — no settlement role)

Zookzy acts solely as a technology intermediary. We do not sell tours, do not create packages, and are not responsible for the performance of services provided by third-party providers.

Zookzy provides solely a technical platform for publishing listings, search, and making contact information available (phone, WhatsApp, messenger links, in-service chat) to connect users seeking services with providers (services, accommodation, tours, transport, etc.).

Zookzy does not participate in settlements between users and providers. We do not take mandatory commission on deals with providers, do not process payments for third-party services, and do not act as escrow agent, payment intermediary, tour operator, insurer, or real-estate agent.

A cooperation request (buttons such as "Request", "Contact", "Message", or similar) is a technical tool to send a message to the provider. It does not create a legally binding contract between you and Zookzy. Confirmation, payment terms, cancellations, and refunds are exclusively between you and the provider.

Providing contacts (phone, WhatsApp, chat link) to tourists and other users seeking services is free. Platform fees apply only to providers, advertisers, and others publishing commercial content — not to tourists for browsing the catalogue, viewing contacts, or sending a request. We do not control, moderate, or guarantee that a provider will respond, perform a service, or refund money.

Platform fees (if any) relate only to our own services for providers and advertisers — for example paid listing placement ("boost"), credits for visibility, and advertising tools. Tourists and other users seeking services do not pay Zookzy for contact access or sending a request to a provider. Those fees are not connected to deals with service providers.

Zookzy does not disclose tourists' or other service-seekers' contacts to providers or third parties automatically. We do not require tourists to provide a phone number, home address, passport data, or other personal details to browse the catalogue, send a provider request, or use basic platform features. If a provider needs your contact to communicate, we offer a technical option (e.g. "Show phone" or in-service chat), but you are not obliged to use it and may contact the provider by any other means without disclosing your data through the platform. Providers do not receive your contacts without your explicit, informed consent expressed through platform actions (e.g. sending a chat message, tapping to reveal a number, completing a request form). If you prefer not to disclose your contacts, you may use anonymous chat or reach the provider via third-party messengers using contacts shown in the listing, without using the platform.

You may decline to interact with a chosen service or provider at any time, without giving reasons, and need not contact the provider via Zookzy-provided contacts. Sending a cooperation request or tapping "Request", "Contact", "Message", or similar does not obligate you to enter a contract, pay, use the service, or continue communication. You are not obliged to reply to the provider, accept their terms, confirm a booking, or take any service-related action. Any interaction with the provider — including messaging, contracting, payment, cancellation, and refunds — is solely at your voluntary discretion and on your terms. Zookzy may not require you to complete a deal with a provider, impose services, or otherwise limit your freedom of choice.

SMS bridge and notifications (where enabled)

Where the SMS bridge is available, Zookzy may relay transactional SMS to providers and clients via a platform number (cooperation requests, codes, Honesty programme PINs). This is a technical contact channel; Zookzy does not participate in settlement between the parties, is not escrow, and does not guarantee the service. Voluntary Honesty programme fees (if the provider opted in) relate only to platform tools for the provider, not the provider's service price, and are not charged to tourists. Providers give separate SMS consent when publishing a listing; declining SMS does not block publication unless the interface states otherwise. SMS may include an opt-out instruction (e.g. STOP) where required by local law.

No interaction with tourism service providers through the platform creates legal relations between Zookzy and the end user regarding the tourist service, and Zookzy is not responsible for providers' compliance with applicable tourism regulators requirements or other tourism regulators.

4. Account, credentials, and security

You must provide accurate information and keep it up to date. You are solely responsible for safeguarding passwords, devices, OAuth connections, and for all actions taken through your account, even if a third party acted without your knowledge (except where you prove access resulted from a compromise of Zookzy infrastructure caused by our fault).

You must notify us immediately of any unauthorised access. If you do not notify us, we treat all actions as authorised.

We may suspend or delete an account without prior notice if we suspect risk, a breach of law or these Terms, or failure to complete reasonable checks (e.g. refusing to provide documents for verification).

Zookzy takes reasonable technical measures to protect user data; however, we do not store or display in plain form critical data including, without limitation: full payment card numbers (PAN), CVV codes, card expiry dates, access passwords, passport data (except where the law expressly requires it for verification), medical data, biometric data, or other information classified as sensitive personal data under applicable law. Any such information, if collected, is stored encrypted and used only for purposes expressly stated in these Terms or the Privacy Policy. We do not disclose tourists' contacts to providers — a provider sees only your name (if you provided it) and your message sent through the platform. Your phone number and email are not passed to the provider automatically and are disclosed only with your explicit consent during communication via built-in platform tools (e.g. chat, "Show phone").

The email address you provide at registration is used primarily to sign in to your account, recover access, receive transactional notices related to the Service (e.g. Terms changes, security alerts, account confirmations), and to contact you about matters directly concerning your account or use of the platform. We do not share your email with providers or third parties without your explicit consent, except where the law expressly requires it. We do not use your email for bulk marketing, advertising campaigns, spam, or other purposes unrelated to providing the Service unless you give separate consent. You may opt out of non-essential notices via account settings or an unsubscribe link in email. Use of your email is governed by our Privacy Policy.

5. Listings, reviews, and user content

You retain rights in your content, but you grant Zookzy a perpetual, non-exclusive, royalty-free, worldwide, transferable (including sublicensable) licence to:

• host, reproduce, adapt (including machine translation, photo cropping, format changes, layout), publicly display, distribute, promote, and operate the Service;
• use the content to train and improve ranking, security, and AI systems, and for moderation and anti-fraud purposes.

You represent and warrant that:

• you have all rights, consents, and licences required to publish the content;
• you are the lawful owner of the object, goods, or services described in the listing, or act under direct written power of attorney or other proper authority from the lawful owner granting you the right to publish the listing and deal with the object (including, without limitation, rental, sale, temporary use, organising tours, excursions, or transfers);
• the object, goods, or services described are not stolen, hijacked, seized, confiscated, unlawfully held, subject to ownership disputes, encumbered by third-party rights that exclude or restrict rental, sale, or use, or otherwise obtained unlawfully;
• the object, goods, or services are not under arrest, subject to ownership litigation, mortgaged, pledged, charged, subject to court injunctions, security measures, or other obligations enforceable against that object, unless such encumbrances are clearly and unambiguously disclosed in the listing before contracting with a user; concealing encumbrances is a material breach of these Terms and grounds for immediate listing removal without prior notice and without refund of paid platform fees;
• you hold all permits, licences, insurance, and other documents required by applicable law for the activity described (including, without limitation, tourism regulators licences, transport permits, hotel certificates, sanitary approvals);
• the content is truthful, not misleading, and complies with applicable law (including, without limitation, consumer protection, intellectual property, personal data, anti-money-laundering, foreign registration, tourism, and hospitality laws).

Prohibited content includes, without limitation: malware, illegal goods/services, hate or terrorist content, non-consensual intimate imagery, infringement of third-party IP, spam, phishing, and listings for objects the provider does not lawfully control.

We may remove or restrict any content at our sole discretion without an obligation to pre-screen everything or to give reasons, except where the law requires justification.

Zookzy is not obliged to verify ownership, power of attorney, lawful possession, or other legal grounds for publishing a listing. All responsibility for lawful publication, ownership, and permits lies solely with the provider. If Zookzy receives a substantiated notice that an object, goods, or services were published without lawful grounds, we may immediately remove the listing without prior notice and without refund of paid platform fees.

Zookzy does not verify the accuracy of photos, descriptions, specifications, prices, availability, or condition of objects, goods, or services in listings. All photos, text, video, 3D tours, panoramas, and other visual or textual materials are provided by providers "as is" without any warranty that they reflect reality. Zookzy is not liable for visual or textual content not matching the actual condition, including without limitation: recent renovations, interior changes, neighbouring construction, seasonal landscape changes, closed facilities (pools, restaurants, beaches), or other circumstances that may differ from photos or descriptions. Users must independently verify information before deciding. If you find misleading information, report it via Report and we may consider removal.

6. Cooperation with providers, payment, cancellations, and risks — no Zookzy liability

Because Zookzy does not collect payment for providers' services, all financial and contractual relations arise directly between you and the provider (listing owner).

How do you contact a provider? You send a cooperation request via the listing form or call/write using the contact provided. The provider alone decides whether to accept your request, on what terms, and at what price.

Where and how do you pay? You pay the provider directly — cash, card transfer, terminal, messenger, or any other method you agree with them. Zookzy does not receive, hold, return, or guarantee refund of those funds.

Cancellations and refunds. If you cancel or the service was poor quality, you resolve that exclusively with the provider. Zookzy has no leverage to compel a provider to refund money and does not compensate losses.

Risks you accept. You alone are responsible for vetting the provider, reliability, licences, hygiene, and accuracy of the service description. Zookzy does not vet providers beyond basic listing moderation for obvious violations and does not warrant that a listing is not fraudulent. Zookzy recommends that users verify licences through official registries, including the applicable tourism regulators, and not rely solely on information shown in a listing.

Travel-specific risks. You must arrange visas and insurance, follow safety rules and local laws, and verify tour, transport, and accommodation information. Zookzy is not liable for injury, lost baggage, flight cancellations, natural disasters, armed conflict, force majeure, or other events affecting your trip.

You must comply with all laws, rules, and customs of countries you visit, including without limitation: immigration rules, visa requirements, residence rules, prohibitions on work without permits, tax obligations, traffic rules, laws on photography and filming in public places, and cultural-heritage protection laws. Zookzy is not liable for your actions breaching the laws of countries you visit or your country of residence, including fines, deportation, criminal prosecution, or other consequences.

Safety recommendation: do not send full prepayment to unknown providers without checks. Prefer safer settlement (e.g. pay on delivery). Report suspicious listings via Report.

7. AI features

Ranking, recommendations, transcription, chat assistants, auto-filled fields, machine translation, and similar features use machine learning. Output may be wrong, incomplete, outdated, or inappropriate.

You must independently verify critical facts (prices, dates, addresses, licences, visa rules) with the provider or official sources. Use of AI features does not create legally significant outcomes in your favour unless mandatory law provides otherwise.

You may not use AI to evade the law, deceive consumers, generate prohibited content, or manipulate ratings.

7a. Chat assistants and generative AI (disclaimer)

The Service may include chatbots, voice and text assistants, automatic translators, summarisers, recommendation systems, and other artificial-intelligence features, including generative models ("AI features").

You acknowledge and agree that:

(a) AI features are under active development and training. Their output (answers, recommendations, translations, transcriptions, summaries) may contain errors, inaccuracies, outdated information, logical contradictions, hallucinations (factually false statements), or otherwise fail to reflect reality.

(b) Zookzy does not guarantee the accuracy, completeness, timeliness, safety, or legal significance of any content generated by AI features, including without limitation: prices, availability, check-in dates, cancellation terms, document requirements, visa rules, provider licences, service quality, weather, road conditions, regional safety, or any other information that may affect your decisions.

(c) You use AI features entirely at your own risk. AI assistant responses are not legal advice, medical advice, financial advice, or official confirmation by Zookzy. You may not rely on them as your sole source of information when making decisions, especially regarding travel, bookings, payments, contracts, or other legally significant actions.

(d) You must independently verify critical information with service providers or official sources (including, without limitation, official hotel and airline sites, consulates, regulators, and applicable tourism regulators) before acting on AI output.

(e) Zookzy is not liable for any direct or indirect loss arising from use or inability to use AI features, including without limitation lost profits, mistaken bookings, financial loss, spoiled travel, injury, or property damage, even if Zookzy was advised of the possibility of such loss.

(f) Communication with an AI assistant does not create a contractual relationship with Zookzy or amend these Terms. If AI output conflicts with these Terms, the Privacy Policy, or Zookzy's written statements, the latter prevail.

(g) We may change, limit, suspend, or discontinue any AI feature at any time without prior notice or explanation.

(h) You may not use AI features to generate prohibited content, deceive other users, manipulate ratings, scrape data automatically, or otherwise breach these Terms or applicable law.

(i) Zookzy takes reasonable measures to filter malicious links generated by AI but does not guarantee that all links provided by AI assistants are safe. You must verify links before following them and use antivirus software. Zookzy is not liable for harm from following links generated by AI features.

8. Prohibited conduct (non-exhaustive)

Without limitation, you must not:

• bypass access controls, including using a VPN to access from blocked regions;
• scrape or mass-collect data (manually or automatically) without our written permission;
• attack infrastructure (DDoS, vulnerability scanning, password guessing);
• impersonate people or organisations;
• inflate reviews, likes, views, or ranking;
• send spam (including through cooperation requests);
• collect other users' personal data without a lawful basis;
• facilitate human trafficking, illegal weapons or drugs, document forgery, or financial fraud;
• harm other users' security (e.g. sending malware links);
• create fake accounts to inflate reviews, ratings, views, or likes;
• use bots, scripts, or other automated means to manipulate ranking or listing popularity;
• collude with other providers to create false positive or negative reviews;
• publish reviews on behalf of third parties without their direct consent;
• remove or hide substantiated negative reviews through threats, blackmail, or offers of reward.

Breach may result in immediate account suspension without notice and without refund of amounts paid, except where the law requires a proportional refund.

8a. Fraud, safety, and user protection

Zookzy does not verify the good faith, solvency, reliability, criminal record, credit history, business reputation, or other risks of providers, advertisers, or users. We do not screen users against sanctions lists, fraud lists, dishonest-provider registries, tourist-agent blacklists, tourism regulators registries, or other databases, except where the law expressly requires such checks and they are technically feasible.

You acknowledge and agree that:

(a) Zookzy is not a party to deals, contracts, agreements, or other obligations between users and providers. We do not guarantee that a provider will perform, refund money, deliver quality service, meet deadlines or terms, refrain from fraud, provide accurate information, or comply with the law.

(b) Zookzy does not guarantee that a provider holds valid licences, permits, insurance, certificates, or other documents required for lawful activity described in a listing. Any licence or permit information in a listing is provided by the provider and is not confirmed by Zookzy.

(c) Zookzy is not liable for losses, injury, property damage, business reputation harm, moral harm, or other negative consequences arising from fraud, non-performance, poor service, unlawful acts, or inaction by providers or third parties, even if Zookzy was notified of the possibility of such consequences.

(d) You must exercise due care when dealing with providers, including without limitation: checking reviews, documents, licences, physical condition of premises, contract terms, price, hidden fees, insurance, and meeting or video-calling before payment. We strongly recommend never sending full prepayment to unknown providers and using safer settlement (e.g. pay on delivery, escrow, or credit card with chargeback rights).

(e) We may (but are not obliged to) post fraud warnings, publish safe-payment guidance, block suspicious accounts, request additional documents from providers, and remove listings that raise reasonable doubt. Such actions are at our sole discretion, do not create a duty to protect users from fraud, and are not a guarantee of safety, reliability, or lawful provider activity.

(f) We may report suspicious accounts, fraud, or legal breaches to competent authorities (including police, tourism regulators, financial intelligence, and tax authorities) without prior notice to the user.

(g) Under no circumstances will Zookzy compensate monetary loss, lost profits, injury, property damage, or other harm related to fraud, provider non-performance, poor services, or unlawful acts by third parties, including where a user relied on information on the platform or via AI features.

9. Intellectual property

The Zookzy name, logos, UI design, software, databases, and ranking algorithms are protected by copyright, patents, trade marks, and other rights belonging to Zookzy or its licensors. Copying, decompilation, reverse engineering, or creating derivative works without our written consent is prohibited. Trade marks mentioned in listings belong to their respective owners.

10. Copyright / IP complaints

If you believe your rights are infringed on the Service, send notice via Contacts with the subject "Copyright claim", including:

• identification of the right (registration number, link to the work);
• URL or identifier of the infringing page;
• a good-faith statement under penalty of false claims.

We may remove material and restrict infringing users. Repeat infringement may result in a permanent ban.

11. Third-party services and links

Maps (Google Maps, OpenStreetMap), OAuth providers (Google, VK, Yandex, etc.), analytics, payment providers (if any), messengers, and external sites are governed by their own terms. We are not liable for their outages, data leaks, misconduct, or API changes, except where mandatory law requires otherwise.

12. Fees, taxes, and chargebacks (platform services for providers and advertisers only)

Zookzy may charge only providers, advertisers, and others publishing commercial content for the platform's own services, such as:

• paid listing placement ("boost");
• credits for search visibility;
• advertising tools and banner placement.

Tourists and users seeking services do not pay Zookzy to browse listings, view contacts, send requests to providers, or otherwise use the catalogue as consumers. These fees are not connected to deals with service providers. You pay Zookzy directly (if you are a provider or advertiser); they are non-refundable once the service was delivered (e.g. your boost was shown a given number of times), except where the law expressly requires otherwise.

A chargeback disputing a platform payment without lawful grounds breaches these Terms. For unfounded chargebacks we may suspend the account until the dispute is resolved and recover our costs (including payment-processor fees). We are not liable for chargebacks you initiate against service providers — that is solely between you and the third party.

All payments for platform services (including without limitation boosts, credits, subscriptions, and advertising tools) are processed exclusively through licensed and certified payment providers registered and operating in the user's jurisdiction where required by law. Where the Service requires a local currency for a market, transactions in that currency are processed through licensed local payment providers as required by law. Zookzy does not accept, store, or process bank card data (PAN, CVV, expiry) on its servers — card data is entered only on the payment gateway. We are not liable for security of data transmitted to a payment provider, except where mandatory law requires otherwise. Use of payment providers is governed by their own terms and privacy policies, which you must review before paying.

Platform credits (account balance)

If a provider or advertiser profile includes a balance ("wallet"), that balance consists of prepaid platform credits — an accounting unit used to pay for Zookzy services only (paid placement, boosts, advertising tools, and similar Service features). Tourists and users seeking services generally do not top up such a balance.

• Credits are not a bank deposit, e-money, payment account, or funds for settling transactions between users and service providers.
• Credits are not transferable to other users and are generally not withdrawable to a bank account or card, except where mandatory law or a separate written Zookzy policy expressly requires otherwise.
• Top-ups (where available) are processed through a licensed payment gateway (hosted checkout); card credentials are entered only on the gateway's page — Zookzy does not collect or store full card data (PAN/CVV).
• In countries where law or Service settings require local currency (e.g. the market's local currency), the balance and platform prices are displayed and debited in that currency; internal catalog prices may be kept in USD and converted at the published rate at payment time.
• Once a platform service has been delivered (e.g. a boost was shown), amounts are generally non-refundable except where the law or our refund policy expressly requires otherwise.

Separate programmes (partner payouts, agent commissions) may have their own verification and payout rules; they are not the same as the standard balance used to pay for Service features.

Optional "Honesty" programme (voluntary reporting)

Where the Honesty programme is available, a provider may voluntarily report a completed deal with a buyer they contacted via Zookzy (contacts, PIN, cooperation request). Zookzy may then charge a voluntary platform fee for contact, reporting, and trust tools — not for the provider's service itself and not as a participant in settlement between you and the provider.

• The fee applies only if the provider opts in and confirms the deal; buyers are not required to pay Zookzy for the provider's service.
• Payment for accommodation, tours, transport, or goods still goes directly to the provider; Zookzy is not a party to that service contract.
• Declining the programme does not remove access to basic contact features unless the interface states otherwise.

13. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SECURITY, FREEDOM FROM ERRORS, UNINTERRUPTED OPERATION, CONFORMITY WITH DESCRIPTION, OR ACCURACY OF INFORMATION.

NO ADVICE OR INFORMATION FROM ZOOKZY CREATES A WARRANTY UNLESS IT IS EXPRESSLY SET OUT IN A SEPARATE WRITTEN AGREEMENT.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW (INCLUDING THE LAW OF the relevant market country, SUBJECT TO NON-WAIVABLE CONSUMER RIGHTS IN YOUR COUNTRY THAT OVERRIDE THIS CLAUSE), ZOOKZY AI TECHNOLOGIES (PVT) LTD, ITS AFFILIATES, DIRECTORS, EMPLOYEES, CONTRACTORS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION);
• DAMAGE CAUSED BY ACTS OR OMISSIONS OF OTHER USERS OR THIRD PARTIES (INCLUDING PROVIDERS);
• DAMAGE FROM INABILITY TO USE THE SERVICE OR ANY PART OF IT;
• DAMAGE FROM INACCURACIES, ERRORS, OUTAGES, FAILURES, VIRUSES, OR DATA LOSS.

ZOOKZY'S AGGREGATE LIABILITY FOR DIRECT DAMAGES IN ANY TWELVE-MONTH PERIOD SHALL NOT EXCEED THE GREATER OF:

• (A) THE PLATFORM FEES YOU PAID TO ZOOKZY IN THAT PERIOD (CAPPED AT USD 1,000), OR
• (B) TEN US DOLLARS (USD 10).

THIS CAP APPLIES EVEN IF ZOOKZY WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

15. Indemnity

You will defend, indemnify, and hold harmless Zookzy AI Technologies (Pvt) Ltd, its affiliates, directors, employees, agents, and contractors from any claims, suits, losses, liabilities, damages, costs, and attorneys' fees (including litigation costs) arising directly or indirectly from:

• your content, listings, or messages;
• your dealings with third parties (including, without limitation, disputes over cooperation with providers, payment, refunds, or service quality);
• your breach of these Terms, the law, or third-party rights;
• your use of AI features without verifying outputs.

This indemnity survives termination of the Terms.

16. Suspension and termination

We may restrict, suspend, or terminate your access to the Service without prior notice at any time at our discretion, including but not limited to: breach of these Terms, unusual activity, legal requirements, or discontinuation of the Service. You may stop using the Service at any time by deleting your account. Provisions that should survive (IP, disclaimers, liability limits, indemnity, governing law) survive termination.

17. Governing law and disputes

These Terms are governed by the laws applicable at the Operator's principal place of business (see Contacts), excluding conflict-of-law rules. If you are a consumer in a jurisdiction with mandatory rules (e.g. EU, UK, Brazil) that grant you additional rights notwithstanding the choice of that governing law, those rules prevail to the extent they cannot be contractually waived.

Pre-litigation: before court proceedings you must send a written claim via Contacts and give us 30 calendar days to resolve the matter in good faith. Only after that may you initiate court action.

Jurisdiction: unless mandatory rules provide otherwise (e.g. EU consumer jurisdiction at your place of residence), all disputes shall be heard by the competent courts of the Operator's principal place of business. You consent to the personal jurisdiction of those courts.

18. Sanctions and export control

You must comply with applicable sanctions of the UN, US, EU, UK, and other competent bodies, as well as anti-money-laundering / counter-terrorist financing laws. You must not use the Service if you are on sanctions lists, are located in a sanctioned country, or if your activity violates export controls. We may block access from certain regions or for certain persons without explanation.

Providers and users must not use the platform to launder proceeds of crime, finance terrorism, evade taxes, trade unlawfully, conceal income, or for other unlawful purposes. We may request from providers documents proving source of funds, lawful activity, tax registration, licences, and other information required by applicable AML/CFT law. If requested documents are not provided within a reasonable period (not more than 14 calendar days) or there are reasonable suspicions of unlawful activity, we may immediately suspend or delete an account without prior notice, block access to platform funds, and notify competent authorities (including competent financial-intelligence units). We are not liable to the provider for losses from such actions if taken in good faith on reasonable suspicion.

18a. Tourism and provider licences

Zookzy is an information and listings marketplace, not a tour operator, travel agent, package-tour organiser, hotel, carrier, or seller of services to end users in its own name. We do not provide tourist services ourselves, assemble package tours, collect payment for accommodation, excursions, or transport on behalf of providers, or issue travel vouchers.

Listings for tours, excursions, transfers, accommodation, and other services are published by independent providers. Each provider is solely and exclusively responsible for compliance with applicable local law, including — where applicable — tourism licensing (including requirements of the applicable tourism regulators), transport, hospitality, and other sector rules. Zookzy does not verify providers' licences before publication, does not confirm their validity, and does not warrant any licence, except for voluntary verification procedures that do not create a legal duty to verify. However, Zookzy reserves the right to conduct spot checks, request documents from providers at any time, and remove listings when discrepancies are found, regardless of whether complaints were received.

A request sent through Zookzy is a message to the provider, not a contract with Zookzy. Contract, price, payment, and performance are directly between you and the provider.

If you are a tourism service provider, you must publish lawful offers, provide accurate information, and hold all permits, licences, and insurance required by applicable law.

Providers must inform users of any circumstances that may affect service quality, safety, comfort, or expectations, including without limitation: noisy neighbouring works, temporary closure of beaches, roads, or public places, construction on or near the premises, interruptions to electricity, water, internet, air conditioning, or other utilities, repair work on site, animals on the premises, restrictions for children, elderly people, or people with disabilities, mandatory check-in deposits, additional fees, commissions, or taxes not included in the price, special document, insurance, or visa requirements, and any other circumstances that may affect a user's decision. Concealing such circumstances is a material breach of these Terms and grounds for listing removal, account blocking, and application of Section 15 (Indemnity) without refund of platform fees.

Licence self-declaration. For categories where applicable law requires a tourism licence (including tourism regulators), you enter your licence number in your profile and confirm it is accurate when publishing. Zookzy checks format and presence only — we do not confirm registration in the official tourism-regulator registries or warrant the licence. On the listing page the number is shown as declared by the provider. Zookzy also clearly states that the licence number is provider-supplied and not confirmed by the platform, and provides a link to the official official tourism-regulator registries (where available) for independent verification.

Liability for inaccurate information. Knowingly false licence numbers, licensing status, or permits are a material breach of these Terms. The provider alone bears liability, including full indemnification of Zookzy under Section 15 (Indemnity). If Zookzy was misled and acted in good faith as an information intermediary, it may remove the listing immediately without refunding the provider's paid platform services.

Regulator requests and complaints. Zookzy reserves the right to immediately hide, suspend, or remove any listing, restrict or block a provider account at its discretion, or upon a substantiated request from a competent public authority (including, without limitation, the applicable tourism regulators), without prior notice to the provider, where we have reasonable grounds to believe that:

• the listing or provider's activity breaches applicable law;
• the provider lacks required licences, permits, or insurance;
• a consumer or regulator complaint indicates a breach;
• continued publication creates risk to users or the platform's reputation.

Zookzy is not obliged to independently verify such grounds before acting and is not liable to the provider for losses from such preventive blocking unless it is proved that Zookzy acted with gross negligence or intent.

After measures are taken, the provider may within a reasonable period (not more than 14 calendar days) furnish Zookzy with proof of valid licences, permits, and other documents sufficient for lawful provision of the advertised services. Restoration of a listing or account is solely at Zookzy's discretion after satisfactory review. Refusal to provide documents or knowingly false information is unconditional grounds for permanent removal and account blocking without restoration and without refund of paid platform fees, except where the law expressly requires otherwise.

Advertisers. When purchasing ad placement you confirm that your creative and landing page are lawful, do not mislead about licences, and do not suggest that Zookzy sells tours or acts as a tour operator. Zookzy may reject or suspend any advertisement upon a regulator's request without explanation.

19. Electronic communications

You agree to receive notices electronically (email, push notifications, in-Service messages). You must keep your email address current. A notice is deemed received within 24 hours of sending, whether or not you read it.

20. Assignment

We may assign or transfer our rights and obligations under these Terms in whole or in part (including in a merger, acquisition, or asset sale) without your consent, subject to notice. You may not assign the Terms without our written consent; any attempted assignment is void.

21. Severability and entire agreement

If any provision is held invalid, illegal, or unenforceable, the remaining provisions remain in full force. These Terms together with the Privacy Policy, Cookie Policy, and any additional terms for paid features constitute the entire agreement between you and Zookzy regarding the Service and supersede all prior agreements.

22. Contacts

For legal matters, content removal requests, and IP complaints — use Contacts. For personal-data requests, follow the Privacy Policy. For pre-suit claims you must include "LEGAL CLAIM" or "PRESUIT" in the subject line.

22a. Personal data processing and privacy

Providers who publish listings and receive access to users' personal data (including without limitation names, phone numbers, email addresses, home addresses, passport data, payment card data, and other information voluntarily provided by users) must process such data solely to perform obligations under the deal for which the data was provided.

Providers must:

• (a) not use users' personal data for marketing, advertising, or other purposes unrelated to performing the specific deal without explicit separate user consent;
• (b) not transfer personal data to third parties except where necessary to perform the deal (e.g. sharing data with a guide, driver, or hotel) and the user was notified in advance;
• (c) not retain personal data longer than necessary to perform the deal and comply with tax, accounting, or other applicable legal requirements;
• (d) take reasonable technical and organisational measures to protect personal data from unauthorised access, loss, destruction, alteration, disclosure, or other unlawful processing;
• (e) promptly notify Zookzy and the user of any breach or unauthorised access to personal data known to the provider.

The provider bears full and exclusive responsibility for breaches of personal data protection law (including, where applicable, the EU General Data Protection Regulation / GDPR, applicable national personal-data laws, and other applicable rules) and must indemnify Zookzy for all losses, legal costs, fines, and expenses arising from such breaches under Section 15 (Indemnity) of these Terms.

Zookzy does not store or process users' personal data for purposes unrelated to providing the Service and is not liable for providers' handling of personal data obtained through the platform, except where mandatory law requires otherwise.

By using the Zookzy Service you confirm that you have read, understood, and agree to these Terms of Service and to the Privacy Policy and Cookie Policy.
